1. GENERAL AGREEMENT
1. Internet shop “Organicera.eu” is a website owned and maintained by Yeni Hayat Organik Tekstil San Tic Ltd Sti, legal address : Turan Sokak, no 14/A, Kağıthane, Istanbul. “Organicera.eu” is operated by Agentur Syster Yster- Nina Kern, legal adress: Winkel Strasse 13, 79798, Jestetten, Germany,
2. Intellectual property rights to “organicera.eu” belong to Yeni Hayat Organik Tekstil San Tic Ltd Sti.
3. “organicera.eu” has the right to change the content of the website and the terms of use and they come into force upon publication.
4. By accessing the www.organicera.eu website and using it, the user confirms that he has read its terms of use and agrees to abide by them.
5. Before placing an order, the Customer must confirm that he has read these terms, as well as the Terms of delivery of the Goods and the Right of Withdrawal.

2. PLACING AN ORDER
6. In order to make a purchase at www.organicera.eu, the customer must place an order for the Goods.
7. Only registered and unregistered users can place orders on www.organicera.eu. If the Customer creates his/her user account www.organicera.eu (hereinafter – ORGANICERA account), the Customer has the opportunity to join the Online Store by logging in. In order to register an account, the Customer must fill in the relevant registration application and agree to the Terms of Use.
8. In order to place an order, the corresponding Goods must be added to the shopping cart and the “Confirm order” button must be pressed.
9. Products will only be delivered EU countries + Switzerland . The time frame for delivery will be taken into account as precisely as possible. Wrongly communicated delivery addresses are the responsibility of the buyer and can lead to additional costs.
The prices do not include delivery costs. Delivery costs will be shown at the basket, before the final check out.
After receiving the order payment, we will send the orders within 3 working days (the shipment reaches you within 6-7 days). Delay in delivery cannot lead to severance of the purchase or a compensation for the buyer, except in the case of deliberate delay. When one or several products ordered by the buyer are not available at the time of ordering, the seller cannot process the complete order. In this case, the seller has the right to deliver the order partially.
Deliveries are done with DHL to the all the countries which are member of the EU ( except for Switzerland) . Deliveries are done with post service for Switzerland.
– Within Germany delivery charge per order is 4.99 €
– Within Switzerland delivery charge per order is 8.99 €
– To all the other address in EU, the delivery charge is 15.99 €
– Only within Germany for purchases over EUR 75.00, the delivery is free of charge.
10. www.organicera.eu is not responsible for any losses or other consequences arising from incorrect data specified by the customer in the order.
11. Purchase payment is possible in the following payment methods:
a) via Bank Transfer trough Wise.
b) Paypal
c) Debit and Credit Card through PayPal.
If the direct & debit payment method is chosen, the amount due will be collected by “organicera.eu . If the prepayment payment method is chosen, the goods will only be delivered when the full amount is on the named “organicera.eu” account. When paying with payment cards before making a payment, the Customer checks whether the Products shown in the order, their quantity and prices correspond to his wishes.
12. www.organicera.eu sends the Customer an automatic e-mail with the Order confirmation. If the Customer notices any errors in the order confirmation message (unwanted goods, quantities, etc.), the Customer must immediately contact www.organicera.eu customer support by Whatsapp + 90 546 6315748 or by e-mail: info@organicera.eu.
13. The order is payable immediately, in full. Once the payment has been made, the order is considered submitted and the Goods are assembled.
14. In case, after placing the order, “www.organicera.eu” cannot deliver the ordered product or the desired quantity, “organicera.eu” is entitled to exchange the product for an equivalent one in consultation with the Customer.
15. If the Product cannot be replaced or replaced, or if the Customer is not satisfied with such exchange upon receipt of the Product, the Customer is entitled to cancel the order and the money will be returned to the Customer’s bank account within 14 working days. “www.organicera.eu” is entitled to refuse the execution of the order, notifying the Customer thereof and indicating the reason for cancellation. In case “www.organicera.eu” does not fulfill the order, the money is returned to the Customer within 14 working days.
16. www.organicera.eu is entitled to refuse to fulfill the order by notifying the Customer and indicating the reason for cancellation by e-mail or telephone. In case organicera.eu does not fulfill the order, the money is returned to the Customer within 14 working days.

3. DATA CONFIDENTIALITY
17. www.organicera.eu online store users have the opportunity to register as a regular user by creating their own user profile.
18. The user is prohibited from disclosing his access data to other persons.
19. By using the www.organicera.eu online store, the user agrees to the processing of personal data. This is necessary for ordering and delivery of goods.
20. The user, indicating his e-mail address, agrees to receive information from the website about various current events and offers.
21. www.organicera.eu may collect and store data that allows analyzing website traffic and usage.

4. DESCRIPTIONS AND PRICES OF GOODS
23. All prices are in euros with VAT. The price does not include delivery costs.
24. Prices are subject to change without notice, as well as discounts may be applied to goods. The Goods are sold at the prices valid at the time of ordering, except in cases when the Product has an incorrect price due to a technical error or system damage. www.organicera.eu, has the right to refuse to sell the Goods ordered in the online store, informing the Customer if the Product is no longer available or due to technical reasons the price and / or parameters of the Product indicated in the online store do not correspond to the actual price and / or parameters. The changes take effect from the moment they are published in the online store www.organicera.eu and they apply to orders placed after the changes are published.
25. Delivery costs (if any) are accounted for separately before payment is made.

5. CANCELLATION OF THE ORDER OR TERMINATION OF THE DISTANCE AGREEMENT
26. www.organicera.eu, until the customer’s payment is received, has the right to cancel the customer’s order if discrepancies in the product descriptions or prices are established.
27. www.organicera.eu, has the right to terminate distance contracts in case the parties suffer excessive losses in the performance of the contract and in other cases specified in regulatory enactments.
28. The buyer has the right to withdraw from the contract and return the goods purchased in the online store to the seller within 14 calendar days without giving a reason.

This deadline is considered to be met if the User sends or returns the goods before the expiry of the 14-day deadline. If you cancel your purchase, we will refund all payments received from you, except for the cost of delivery and return of the goods, which will not be refunded and borne by the buyer, without undue delay and in any case no later than 14 days from the date we were notified. (b) the packaging of the goods has been opened and the goods have been used for purposes other than establishing the nature, characteristics and functioning of the goods.
The goods must be returned in the original packaging, and the buyer must provide appropriate packaging for safe transportation of the goods back to the seller.
